The CollarCam is intended for lawful and ethical purposes only. You agree not to use the CollarCam for any illegal or unethical purpose, including but not limited to:

• Recording or monitoring individuals without their knowledge or consent;
• Recording or monitoring private conversations or meetings without the consent of all parties involved;
• Interfering with the privacy rights of others;
• Using the CollarCam in a manner that violates any applicable law or regulation.

You are solely responsible for your use of the CollarCam and for ensuring that your use complies with these terms of use and all applicable laws. We shall not be liable for any unauthorized or prohibited use of the CollarCam by you or any third party.

The CollarCam and all related intellectual property, including but not limited to patents, trademarks, copyrights, and trade secrets, are the sole property of PetCollarCam. You agree not to use the CollarCam or any related intellectual property for any purpose other than as authorized by these terms of use.

The CollarCam is provided on an “as is” basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the CollarCam will meet your requirements or that its operation will be uninterrupted or error-free.

In no event shall we be liable for any damages arising from the use of the CollarCam, including but not limited to direct, indirect, incidental, punitive, and consequential damages. Our liability for any claim arising from the use of the CollarCam shall not exceed the amount paid by you for the CollarCam.

Additionally, we take no responsibility or liability for any accidental illness or death of pets that may occur while wearing the CollarCam. The user assumes full responsibility for the safety and well-being of their pets while using the CollarCam. The user acknowledges that they have read and understood the instructions and warnings included with the CollarCam and will use the device in accordance with these instructions and warnings to ensure the safety of their pets.

You agree to indemnify and hold us harmless from any claims, damages, and expenses arising from your use of the CollarCam in violation of these terms of use or any applicable law.

We may amend these terms of use at any time by posting the updated terms on our website. Your continued use of the CollarCam after such amendments constitutes your acceptance of the updated terms of use.

Residents of the EU: Without prejudice to your right to bring an action against CollarCam in the competent courts of the Member State where you are domiciled, we will try to resolve any disputes with you quickly and efficiently if you are not satisfied with your purchase. In such case, we invite you to contact us as soon as possible via our email: hello@petcollarcam.com. If we are unable to resolve a dispute with you using our internal complaint handling procedure, we will notify you as such.

Non-EU residents (including USA): Mandatory Arbitration and Class Action Waiver

Any dispute, claim or controversy arising out of or relating to these Terms of Use or the CollarCam shall be resolved through binding arbitration in accordance with the American Arbitration Association’s rules for arbitration of consumer-related disputes and judgment upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

You and we agree that any arbitration shall be limited to the dispute between us and you individually. You agree that you will not participate in a class action against us. We each agree that you may bring claims against us only on an individual basis and not as a plaintiff or class member in any purported class or representative action or proceeding.

If any court or arbitrator determines that the class action waiver set forth in this section is void or unenforceable for any reason or that arbitration can proceed on a class basis, then the arbitration provisions set forth in these Terms of Use shall be deemed null and void in their entirety and the parties shall be deemed to have not agreed to arbitrate disputes.

These terms of use shall be governed by and construed in accordance with the laws of the United Kingdom without giving effect to any principles of conflicts of law.
